In this Privacy Policy of Bankeo, the company operating this Website and the Platform for Connecting Accounting Specialists and Entrepreneurs or Individuals (referred to as " Bankeo™ ", " we", "us ", " our "):
The " Client " refers to a company that uses Bankeo's Services, whether as a matchmaking applicant (as covered by the Terms of Use) or as an accounting specialist registered with the BANKEO network (as covered by the applicable Service Agreement).
" Business Contact Information " is information that relates to the performance of a function within a company, such as an individual's name, title and position, as well as the address, email address and telephone number of the individual's place of work. "The performance of a duty" means that the information must have been collected, used or disclosed for the purpose of communicating with the individual in the course of his or her employment, business or profession.
The " Individual " refers to the individual who visits the Bankeo Website, as well as the individual who requests Bankeo by filling in the form to put you in touch with an accountant on the Bankeo Website.
The " Platform " refers to Bankeo's Website and all of Bankeo's tools, portals and integrated services, including the portal accessible to accounting specialists and the networking processes.
" Personal Information " refers to information that identifies an individual, directly or indirectly. This excludes Business Contact Information, except where privacy laws consider it to be Personal Information. De-identified information within the meaning of the law is not Personal Information.
" Services " refers to the matchmaking services offered by Bankeo between Clients or Individuals and selected accounting specialists, including support by a Bankeo Broker and the use of the Matchmaking Platform.

This Policy applies to Bankeo's Customers, who are companies.
It also contains a section dedicated specifically to Individuals. This specific section is in addition to the Policy applicable to our Corporate Customers.
Bankeo's employees, contractors, agents and partners must comply with the Privacy Policy if they have access to Personal Information in the course of their duties.
In order to protect Personal Information, we have put in place policies, practices and procedures related to the management of the Personal Information we hold or have custody of.
These internal policies and practices govern the collection, use, disclosure, retention and destruction of Personal Information, as well as the handling of complaints, information security and data governance. These policies and practices also provide the framework for operationalizing privacy impact assessments, as well as preventing and responding to potential privacy incidents. All of these policies and practices have been approved by our Privacy Officer.
Bankeo's senior management has delegated the management of the Privacy Program to the Privacy Officer. His duties are to manage and monitor Bankeo's personal information management program internally.
It is the Privacy Officer who approves and implements the policies and procedures for the protection of Personal Information, who ensures that they are working properly and who reports to Bankeo's senior management on the effectiveness of the program.
It is also the responsibility of the Privacy Officer to provide the necessary support in the event of a question, complaint or request relating to the protection of Personal Information. For more information, please see the bottom of the current document.
Since our products are intended for corporate customers, we generally do not have a direct business relationship with the Individual. However, we require our Clients to provide the mandatory notices by law to Individuals and to ensure that the use, collection or disclosure of Personal Information between Bankeo and the Client is authorized, should this be applicable.
It is possible, however, that we collect Personal Information from Individuals when they visit our Website or if an Individual fills out a form to put them in touch with an accounting specialist, available on our Website. In such cases, Bankeo ensures that it obtains all necessary consents for the use and disclosure of Personal Information.
When we develop and improve our Website and Platform, we make sure to limit the fields of collection of Personal Information to what is strictly necessary for the operation of the Website or the Platform, for example in our contact forms or contact requests.
Here are the purposes for which Bankeo collects and uses Business Contact Information through its Website, its Platform and during its provision of Services:
As mentioned above and in very specific cases, Bankeo may collect Personal Information for its own purposes. The following are the purposes for which Bankeo collects and uses Personal Information for its own purposes:
Before any recording of a telephone call, BANKEO will inform you and obtain your verbal consent. You can refuse the registration. Electronic communications with Bankeo or one of its employees, subcontractors, agents or partners are stored in order to ensure the quality of the services provided, the accuracy of the communications made and the training of Bankeo's employees.
In the event that the Client or the Individual refuses to provide the Information necessary for the opening and administration of his or her Client user account or withdraws his or her consent to the use or communication of his or her Business Contact Information or Personal Information, Bankeo may be unable to provide the Client or the Individual with the products and services subscribed to and may be required to terminate its business relationship with the Customer or Individual.
From time to time, Bankeo may need to share Business Contact Information or Personal Information with its subcontractors or agents (" third parties ") to adequately provide our Services or to help us make available all the features of our Platform and Website (maintenance, analysis, legal requirements, fraud detection, marketing and development). These third parties will only have access to the Business Contact Information and Personal Information that is necessary to perform these tasks on our behalf and they are obligated not to disclose or use it for any other purpose.
Please note that these subcontractors or agents may be located in Canada or in other jurisdictions or countries. Please be aware that we have contractual agreements with these companies to ensure the security of the data we entrust to them and that we conduct privacy impact assessments before disclosing any Personal Information outside the province of Quebec. Although the Business Contact Information and Personal Information we transmit are protected by appropriate security measures, the Business Contact Information and Personal Information may be made available to foreign government agencies under applicable law.
Bankeo has established retention periods for Personal Information in its custody. Bankeo will not retain Personal Information for longer than it is necessary or relevant for the identified purposes, unless legal or regulatory requirements provide otherwise. Once these periods have expired, Bankeo will return or destroy the Personal Information in accordance with its internal policies for the management of Personal Information.
As a guideline, the following retention periods apply:
Bankeo makes the security of the Personal Information it collects, uses and holds a priority. Therefore, Bankeo ensures that it implements security measures appropriate to the sensitivity of the data in order to protect Personal Information against risks such as loss or theft, unauthorized access, disclosure, copying, use, modification or destruction.
The Client remains responsible for maintaining the confidentiality of its user ID and password. If the Client has reason to believe that the confidentiality of this information would be compromised, the Client must immediately contact Bankeo at the rprp@bankeo.ca address in order to avoid fraudulent use of this information.
Bankeo relies on the Individual and the Customer to ensure the continued accuracy of the Business Contact Information and Personal Information that Bankeo collects, uses and retains for the purposes mentioned above.
Bankeo's Personal Information Management Program includes incident detection and response practices and procedures, designed to facilitate the reporting of incidents involving Personal Information.
In accordance with the contracts entered into with the Client, Bankeo will provide reasonable assistance to support Clients in the investigation of any incident and in complying with their obligations in relation to the incident, if any, for example with regard to notifications to data subjects and reporting of the incident to the relevant privacy commissioners or other relevant parties.
Since we generally do not have a direct business relationship with the Individual, Bankeo will refer most requests for access to information, correction of Personal Information or other such requests from Individuals to the Client, unless Bankeo has undertaken to do so by contract with the Client, in the context of its provision of Services.
The Bankeo Website includes a feature that allows the Client to configure their user account. To do so, the Customer must log in to access, modify and/or delete the information in its account.
If the Client wishes to close his user account, he must contact Bankeo's customer service at the contact@bankeo.ca address to make a request. The Client's user account will be deleted within ninety (90) days of receipt of a request to this effect by Bankeo and the Business Contact Information, Personal Information, documents and other information stored or recorded therein will no longer be accessible and cannot be retrieved after this period.
However, depending on applicable laws, where you live and how you interact with the Bankeo Website or Platform, you may be granted certain rights regarding the Personal Information we hold about you. Retention period for Individuals' information
Bankeo will only retain your Personal Information for as long as is necessary to fulfill the purposes for which it was collected, in accordance with our internal document retention policies, to comply with legal, tax or regulatory requirements applicable to us or until you ask us to destroy it. After such a period, any Personal Information concerned and held by Bankeo will be destroyed, deleted or anonymized.

As part of the Services covered by this Policy, BANKEO uses a matching algorithm to suggest accounting specialists. This algorithm does not make decisions that produce legal effects; It offers suggestions that you are free to accept or decline. You retain full control of your decisions.
A cookie is a small text file that is stored in a dedicated location on your computer, mobile device, tablet, or other device when you use your browser to visit an online service. This Policy includes other tracking technologies, including but not limited to web beacons and tracking pixels, in the term "Cookie". These tracking technologies are not necessarily stored on your computer or device. All Personal Information that we collect using Cookies or on our behalf is treated with the same level of confidentiality as any other Personal Information that we hold.

We revise the Policy from time to time to comply with applicable laws and to respect our operations. If we update this Policy in any material way, we will notify you by posting a notice on our Website. In any other circumstances, the posting of a new version of the Policy on our Website will suffice in terms of notice and consent to changes to the Policy.
